Thank you for your lovely email, it is always wonderful to hear from former friends who blame the world for their errors.

Sorry to see you still seem to be living in a world of bitterness and unhappiness - threats like this certainly to not aid in developing close friendships. I feel your pain in this regard, I have discarded bitterness and hatred, indeed most of the Filipino community here in the process, and have found a far happier plane of existence.

Anyway, like your husband who seemed to be confused about the law when you tried to have your poor daughter removed from the country for daring to run away in fear (LEGALLY CONFIRMABLE WITH WITNESSES FROM MANY AREAS), you too seem to be confused about the law, in this instance when it comes to photography.
Please allow me to enlighten you regarding photographic copyrite, usage of peoples photos for editorial purposes and not for financial gain.
You will note that this is a free editorial website and does not make 1c in return.

That being said, I would be more than happy to remove your photos if asked in a civil way and not being threatened and harrassed, as is usually the way for select members of my former community.

If you still wish to take legal action I shall be more than happy to go and state the law - even more happier to bring up anything else of interest, like, HYPOTHETICALLY, breach of immigration conditions.

PHOTOGRAPHY RULES AND NET USAGE

Images of People

The most common problem you will run into is a photo with people in it. If you are using their images for editorial purposes, it's usually okay to use them without permission.

If you are using photos with people in them for advertising, you need their permission. People have a right to profit, and exclude someone else from profiting on their photograph or likeness. This right continues after their death and is given to their heirs.

Here's an example to illustrate the difference between editorial use and advertising use. If you had pictures inside a book illustrating people skiing, you would probably not need their permission. If you put that same picture on the cover of the book, you probably should get their permission.

There are areas of legal exposure to also be aware of, regardless of the editorial or advertising use of the photo.

The last bit may be of interest The areas of legal exposure would include no photography of nudity or similarly, possibly offensive behaviour.

I am unsure what crime I have suposedly commited to warrent legal action.

* Photos were all taken with the consent of the person in question.
* Person knew about said photos last year and now threathens legal action.
* Photos do not include nudity or anything offensive.

If it comes to content, then lets look at the following piece from a solicitor and photographer.

As you can gather from the Kidman example above — not in Australia.

Aside from commercial use or Summary Offences issues, consent for photography is not required in this country. It is purely a question of etiquette and taste. As pointed out in the August 2005 Federal Attorney General's Discussion Paper "Unauthorised Photographs on the Internet And Ancillary Privacy Issues", (as quoted on the <anlysphere.com> website):

[…] for any society to function in a relatively free and open manner, there could not realistically be a requirement for all photographs to be taken with consent. If there were such restrictions, candid shots could never be taken, and the media would be severely constrained in the images they show us. Freedom of expression and artistic expression would undoubtedly be adversely affected ... while there may be legitimate circumstances when recording images should be restricted, it would not be practical or desirable to obtain consent from every person all of the time, for example, for use in television news file footage.

In Nov 2005 this view was supported by the NSW Commissioner for Children:

Even the NSW Commissioner for Children, Gill Calvert, agrees that a ban on photography without permission would be overkill. The commission has written to the Government, saying that for any society to function in a "free and open manner", there cannot be a legal requirement for consent to being snapped.

You had their permission to take the pictures at the time you took them, and they allowed you to have them. That is obvious by their response. So you are covered there.
They belong to you. They can ask you to delete them, but they cannot demand it.
Use your judgment about this.

Anyway regardless of the fact I have not commited any offence, I do agree to comply to the request to remove the photographs of you when asked in a civil manner and not using threats of using the law to have me charged for things that just aren't against the law (like, for instance, and purely hypothetically, BREACHING IMMIGRATION CONDITIONS).

The perils of being a railfan - or security guard!

OK it's not often that ' Manila-Downunder' treats all his readers with a quizz, so I am sure you will all join me in immense foamer excitment as I ask you to tell me the difference between the two photos below.

Now before we answer lets look at an incident yesterday at Morandoo railway yard while photographing from a PUBLIC STREET!

Keeping in mind I was already depressed and in a bad mood following recent developments in Sydney, all I wanted to do was have a great day chasing trains in the Hunter and forget what has been happening.
I should say though - it later turned into the best day in ages and the full report, for anyone interested, will soon appear on the
SEMI-RETIRED FOAMER WEBSITE!

After my usual rounds of Newcastle (see my upcoming report on the day) I stopped by a Morandoo Yard with far more interesting locomotives than is usually the case nowdays.
After a U-Turn I proceeded back to park and get photos, over the fence and not on railway property.
While photographing an 80 class an 'SNP Security' car drove up and on seeing me photographing the train drove off, obviously utilizing some brain cells to realise I was one of the hundreds of visiting railfans
looking at trains.


All was proceeding well until I decided to photograph 4836 - which drew the frantic attention of a CHUBB Security guard who saw the photography of a 48 class as a possible action of a terrorist.


I can see Mr Bin Laden right now. Sitting in his cave, pawing over back issues of Railway Digest and having 20 aides research blueprints of the DL531, looking for weaknesses in the design that could be used, the ultimate aim to bring down western civilization.
The future of the world now hinges on a humble 48 class and Mr Chubb (an obvious power hungry cowboy with no comprehension of his actual power on public roads) was going to save us all by removing this highly dangerous railfan of 28 years from the area.

** MISTAKE **

Poor old Mr Chubb had not counted on being subject to the famous Spadge, along with his even MORE famous hatred of these disgusting examples of humanity (almost as much as the gutter trash one deals with in life).
One enjoys informing these people of the actual laws by which they are
bound (why don't they teach security guards this from the outset?) and then invite them to call the police.
I never realised how much I missed confronting these morons while I have been spending time out of the hobby. My growing return of interest was given a huge boost as this feral drove off into the distance and I went on
photographing my trains.

THE 10,000 COUNTDOWN

Its hard to believe that only 14 months since the website started we are now approaching our 10,000 page hit. It would be over this now, but it took a while for me to add a page hit counter. :-)
Much has changed in this time, ne
w friends, old friends who have turned evil, changed interests, the birth and death of a barkada, the start of a new society to raise money for the Philippines and now a return to previous railway based interests in an effort to remove myself from societies scum element.
** It has all been very exciting!

20,000 CHANGES


Much is planned to change this site as we enter the 20,000 stretch.

While we will continue to update friends and family with wha
t we are doing, and of course continuing the tradition of humour that is obviously appreciated, we will be dropping the coverage of the Filipino events we organise and photography of such.

This site has been accused of causing the recent assault at Matraville RSL and it is believed it will lead to yet another unprovoked attack from the scum of society.
Something I certainly don't wish to be resonsible for as it included one of my best friends.
It is with this in mind that I am deciding to comply with peoples wishes and not place any more photos or information on here covering the old barkada and any of the members of it that I still see.
Any personal parties held will just feature our direct family and my Aussie friends who seem to be less affected by the features here.
PLEASE NOTE: Drunken features on our beloved Colonel still remain the mainstay of the website :-)

We will continue to cover items of Philippine interest, the Philippines itself, photography (mine and friends), news, humour, RIHSPI society news and I will still include jokes sent by the remaining Filos I choose to hang out with.
I hope that this will be enough to entice all my beloved readers and friends to keep checking back. If NOT - perhaps the new random hornbag features will help.

When not shredding the drapes and spreading hatred around local Filipino grocery stores, I love to cruise YouTube looking for funny little bits of footage made by clever humanoids;

Lets face it, while I like to give the impression that I am clever (not to mention rich and edumacateded), I fail in comparison to some of the many amazing people who contribute to YouTube.

Today after downing two tins of Whiskers and reading chapter 3 of my bible, I come across the following, extremely funny, cartoon items.
No idea how they are made, but like my kitty litter, I am just glad they were.

~~ TO MOVE OR NOT TO MOVE ~~

THAT IS THE BLEEDIN QUESTION

Oh and what a question it is. For years we have talked of moving up to the beautiful Hunter Valley and lead a totally new and less stressed life. I think the modern wankers call it a 'TREE CHANGE', but I call it freedom, freedom from the crap Syney has to offer, freedom rom the scum that surrounds our lives at the moment, freedom from traffic and freedom to enjoy endless amounts of fresh air in beautiful scenery.

I was originally the primary motivator behind the idea of such a move, with the wife less than impressed. Then I discovered the Filipino community in Sydney and I decided I couldn't move away, while the wife then decided she wouldn't mind. With that life seemingly behind me now, and a lovely weekend spent around the Hunter, I find myself having strange thoughts of racking off and leaving Smogney behind. I mean, everyone else is anyway, Bill and Colonel are both planning moves there shortly, so why not join them. No more aswang, no more gossip, no more lies, just trees, country roads and trains, lots and lots of trains. Someone told me I would be letting the scum win. hehehehehehehe never seeing them again means I win :-)

Now to start the long process of getting the wife to agree again. :-( Have found to Filipino associations in the Hunter Valley and have contacted them. Hopefully I have better luck with them, than that which one has endured in Smogney.

~~ PEOPLE ARE STRANGE ~~

While obtaining a new bog roll for my darling Princess (who was caught in the ladies room with not a paper square to bless her butt with) I got thinking about how strange people can be.
I am not suggesting she is strange, its just that the odour made me think of a number of aswang who have come and gone in my life and left a endless fragrent taste of hatred in my heart.

Yes people are strange:
Take the loonatic in the car who speads up behind you and then cracks a wobbly because you have to slow to make a turn, or the siumilar loonatic that sits on 100kph in a 60 zone, then sticks his finger up at you when you turn onto a street in front of him doing the posted 60.

Then there are the stranger members of the Filipino community who constantly spread bollocks about you, then seem to be mortified when you bring it up on the internet, or dare to retaliate against them.

Many seem to be upset by my burning their photos, sharing their death threats, telling the world about their little nicknames for me, telling about the gossip and of course, their pet hate, my informing the community at large of the truth behind the lies.
I suppose many outsides would say, then if it upsets them, then WHY DO IT???????

Good question. I think they feel they are better than all and that nobody would ever dare to stand up to them. Of course, they hadn't counted on me, someone with a totally disinterest in their pathetic excuse of a social structure.

So if your upset about ebing mentioned here, then I suggest you take a good hard look at yourself, try to work out why it is limited to you, AND START TAKING BLOODY RESPONSIBILITY FOR YOUR ACTIONS YOU GROUP OFF BUFFOONS.

I am not part of the Filipino community here anymore, I don't care what people now think of me, so I HAVE NOTHING TO LOOSE BY PUBLISHING THE TRUTH.
If you have trouble with the truth - learn to either deal with it - or WAKE UP!

THE END OF A VERY FUN ERA!

Following close on the demise of the G-Spot Barkada is the end of karaoke partying in the G-Spot Karaoke and Smut Rooms after many years of fun!
The area will now be turned into an office for the RIHSPI in an effort to utilize this now wasted space.

Recieved an email from beautiful Roxas City yesterday to say that one of my fave neice's Christine has finally graduated.
Christine was doing a course in nursing and, who knows, you may be lucky enough to have her on a future visit to hospital.
Am very proud of you Christine - this is wonderful news - perhaps you can one day be a nurse in Australia.

Christine is one of the few relos in the Philippines who actually took the time to talk to me and is one of the reasons I loved Roxas City so much.

Oy humans, welcome to my column where we discuss may legal things and try to give our readers far more knowledge of whats happening in the world of legalness. If indeed, legalness is a word.

It is a terrible world out there nowdays, crimes being committed everywhere, assault, robbery, gossiping, drug dealing, tax being removed from pay, workchoices, fraud, terrorism, car sales, fictional stories being told in the Filipino community and the list goes on and on.
As a service to MD readers I have been asked to give my thoughts on topics of the day.

Today we start with 'PERVERTING THE COURSE OF JUSTICE', the act of changing ones story, or leaving out important truths, in an effort to change the outcome of a trial.
This is often done by the perpetrator of a crime, or can be also used
by a WITNESS who was either at the event or under the deluded idea that they should defend a friend, right or wrong.
Lets have a look at what the Australian law says.

Section 319 of the Crimes Act states:

A person who does any act, or makes any omission, intending in any way to pervert the course of justice, is liable to imprisonment for 14 years.

Yes indeedy, it is frowned upon greatly and may see one punished more than what the punishment may have been for the original crime.

Indeed it is a puuuurrrrrrfect way to find ones self with free bed and breakfast for 14 years. While an extended holiday is always great, coping it up the root canal from Bruce for 14 years possibly isn't the best of future to look forward to.

I, as an officer of the law, thus ask you to consider this.

If a friend asks you to lie in court as a witness, even if a friend for 14 years, is it worth 14 years worth of jail and the resultant record?

"Ommpphhhh ohhhh - one sec, got to go visit the little kittys litter tray room."

Back, now where was I? Oh yeah.

There are severe penalties for perverting the course of justice, always weight them up. If spending 14 years in jail is preferable than loosing a friendship, or the actual punishment for the crime, then I leave it up to you.

Railways and Industrial Heritage Society Philippines
ANZ Chapter

Things have been busy on this charity front of late, the launching of our first newsletter (see below) has been quickly followed by a huge advertising campain (at my personal expense Oh Great PLASTIC ONE) around the various museums, Filipino associations and Australian Filipino press.

We have been getting some positive feedback and hope to start exhibiting at Filipino events in the future.

We have started taking membership from around Australia, with overseas membership expected to start in coming weeks.
We are extremely fortunate to have the support of the Pasalubong Foodmart in Sydney who now have a donation box available for anyone who is kind enough to give to this worthy historical charity.
Pasalubong Foodmart is currently in the process of developing a website for anyone who wishes to know more. It is in its early days but will be found at

We sincerely thank Pasalubong for their help.
Thanks must also go to the local Filipino media, most especially the Bayanihan News for their continued support.

News from the Philippines has also been great.

Membership has been steadily growing, our first item (an early 1900s rail trike) is approaching full restoration and the society has been asked to inspect 23 carriages that are due for scrapping, with a view to obtaining some for restoration.
The ultimate aim is to restore one of the Philippines historic steam locomotives, of which only three remain, and use it on historic tours out of Manila.
In the meantime a museum is planned which will house items and documents of railway and industrial heritage, as well as act as a museum for people to check out their important history.

We would welcome hearing from anyone who can help, even the smallest donation helps us along and also helps give people work (through help restoring) in the Philippines, not to mention helping the economy as most money raised will be spent on Philippine items.

THE MIRACLE OF TOILET PAPER

Fresh from my shower, I stood in front of the mirror complaining to my
husband that my breasts are too small.

Instead of romantically telling me this is not true, he
uncharacteristically comes up with a suggestion: 'If you want your
Breasts to grow, then take a piece of toilet paper and rub it between
them for a few seconds every day'

Willing to try anything, I got a piece of toilet paper and stood in
front of the mirror, rubbing it between my breasts.
How long will this take?' I asked.
They will grow larger over a period of years,' my husband replies.

I stopped. 'Do you really think rubbing a piece of toilet paper between
my breasts every day will make my breasts larger over the years?'

Without missing a beat he said 'Worked for your bum, didn't it?'

The Bastard is still alive, and with a great deal of therapy, he may even walk
again although he will probably continue to take his meals through a
straw.
